Aviya · Legal

Terms of Use

Effective date: 6 October 2026

These Terms of Use (“Terms”) govern your access to and use of Aviya, including the Aviya mobile application, websites and related services.

Please read these Terms carefully. By creating an account, accessing or using Aviya, you agree to them.

1. Who we are

Aviya is operated by Saul Gibson (Private) Limited (“Aviya”, “we”, “us” or “our”).

Address:
28 Dingle Road
Belvedere
Harare
Zimbabwe

Support: support@aviya.africa
Legal and privacy enquiries: legal@aviya.africa
Website: https://aviya.africa

2. Accepting these Terms

By accessing or using Aviya, you agree to these Terms.

If you do not agree to them, you should not use Aviya.

If you use Aviya on behalf of a business, farm, organisation or another person, you confirm that you have authority to act on their behalf. References to “you” may therefore include that business, farm, organisation or person where applicable.

Certain features may be subject to additional terms. Where this applies, we will make those terms available before you use the relevant feature.

3. Who may use Aviya

You must have the legal capacity to enter into these Terms.

If you are under 18, you may use Aviya only with the permission and supervision of a parent or legal guardian who accepts responsibility for your use.

You may use Aviya only where doing so is lawful.

4. What Aviya provides

Aviya provides tools designed to help poultry farmers organise information and manage their farming operations.

Depending on the version and features available to you, Aviya may include functionality relating to:

  • farms and Batches;
  • bird numbers and losses;
  • bird weights and production records;
  • feed, supplies and inventory;
  • expenses and sales;
  • operational and financial summaries;
  • reminders and notifications;
  • team collaboration and shared Batches;
  • Team Chat;
  • connected devices or sensors; and
  • other farming and business-management tools.

Features may differ between devices, operating systems, application versions, account types, territories and stages of development.

Screenshots, previews, prototypes, roadmaps and descriptions of planned features are illustrative. A feature described as planned, upcoming or in development is not a commitment that it will become available on a particular date.

5. Accounts and sign-in

Some Aviya functionality may be available without an account. Other functionality may require an account, an internet connection or both.

When creating or maintaining an account, you must provide accurate information and keep it reasonably up to date.

You are responsible for protecting your account, sign-in credentials and devices and for taking reasonable steps to prevent unauthorised access.

You must not share credentials in order to give another person access to your account. Where collaboration functionality is available, use Aviya's invitation and permissions features instead.

Please tell us promptly at support@aviya.africa if you believe your account has been compromised or used without your permission.

Where Aviya offers sign-in through Apple, Google or another third-party identity provider, your use of that provider is also subject to its terms and privacy practices. Changes to, suspension of or loss of access to that third-party account may affect your ability to use the corresponding sign-in method.

6. Offline use, local storage and cloud synchronisation

Aviya may allow certain information to be created or stored locally on your device.

Locally stored information may be lost if you uninstall Aviya, clear application data, reset or replace your device, lose your device or experience a device or storage failure.

Where cloud functionality is available and enabled, relevant information may be transmitted to and stored through Aviya's online services.

Cloud synchronisation depends on factors including connectivity, account status, device configuration and service availability. Records created offline may not immediately appear on another device or become visible to other authorised Batch participants.

You should review important records after synchronisation and resolve discrepancies where appropriate.

You should also maintain independent copies of information that you are legally, commercially or operationally required to preserve.

Uninstalling Aviya does not by itself delete your Aviya account or information stored online.

7. Your records and content

You retain any ownership rights you have in information, messages, photographs, records or other content that you submit to Aviya (“Your Content”).

You are responsible for ensuring that you have the right to collect, enter, upload, communicate and share Your Content.

This includes obtaining any permissions or authority required where information relates to another person, employee, worker, supplier, customer or other third party.

You grant Aviya a limited, non-exclusive licence to host, store, reproduce, transmit, display and otherwise process Your Content only as reasonably necessary to:

  • operate Aviya;
  • provide features you choose to use;
  • synchronise information between authorised devices or users;
  • maintain security and service integrity;
  • investigate or resolve technical and support issues; and
  • comply with applicable law.

Where you use a shared Batch or collaboration feature, this permission includes making the relevant content available to participants whom you or another authorised person has permitted to access that Batch.

This licence does not transfer ownership of Your Content to Aviya.

Our processing of personal information is described in the Aviya Privacy Policy.

8. Shared Batches, teams and permissions

Where Aviya supports shared Batches or team access, authorised participants may be able to view, create or change records according to the permissions provided to them.

Batch owners and anyone authorised to manage access are responsible for:

  • inviting appropriate participants;
  • assigning appropriate permissions;
  • reviewing access when circumstances change; and
  • removing access when it is no longer required.

Do not invite another person or disclose information to them unless you have authority to do so.

Actions performed within a shared Batch may be associated with the person and device that performed them and may appear in activity or audit history.

Removing a participant's access prevents future access through Aviya where technically applicable, but it cannot retrieve information that the participant previously lawfully downloaded, copied, exported or otherwise retained.

Disputes concerning ownership of a business, farm or Batch, employment relationships, authority or the accuracy of shared business records are primarily matters between the participants concerned.

Aviya may take reasonable action to protect accounts, preserve service integrity or respond to lawful requests, but does not undertake to determine private ownership, employment or commercial disputes between users.

9. Team Chat and user-generated content

Some Aviya features may allow users to create messages or other content that can be viewed by other users. This is referred to as user-generated content.

Aviya does not tolerate objectionable content or abusive behaviour.

You must not use Aviya to create, upload, transmit or share content that:

  • is unlawful, fraudulent or deceptive;
  • threatens, harasses, intimidates or abuses another person;
  • promotes hatred, discrimination or violence against another person or group;
  • is sexually exploitative or otherwise seriously inappropriate;
  • exploits, harms or endangers a child;
  • impersonates another person or misrepresents your authority;
  • infringes intellectual-property or other legal rights;
  • unlawfully discloses confidential or personal information;
  • contains malware, malicious links or harmful code;
  • constitutes spam, unsolicited advertising or other abusive commercial messaging; or
  • is otherwise inconsistent with these Terms or applicable law.

Where user-generated content features are made available, Aviya may use technical, automated and human moderation measures appropriate to the relevant feature.

Aviya may remove or restrict access to content, restrict communication functionality, suspend a user or terminate access where reasonably necessary to address abuse, protect users, maintain security or comply with law.

Where required for a released user-generated-content feature, Aviya will provide in-app functionality for users to report objectionable content or users and appropriate controls for dealing with abusive users.

Reports may also be sent to support@aviya.africa.

We may investigate reports and take action that we reasonably consider appropriate. Repeated or serious violations may result in permanent account termination.

Communications within a shared Batch may be visible to its authorised participants. Consider the intended audience and sensitivity of information before sending it.

Team Chat is not an emergency service and should not be used as a substitute for contacting emergency services, a veterinarian or another appropriate professional.

10. Calculations, estimates and reminders

Aviya may calculate or display totals, costs, averages, forecasts, estimates, performance indicators or other summaries based on information entered into the service.

Their accuracy and usefulness depend on factors including the accuracy, completeness and timing of the underlying information and the assumptions used.

You should verify information before relying on it for significant purchases, sales, accounting, financial, farming or other business decisions.

Notifications and reminders may be delayed or prevented by device configuration, notification permissions, connectivity, operating-system restrictions, battery-management settings or service interruptions.

Where connected sensors or devices are supported, readings may also be affected by hardware accuracy, calibration, placement, environmental conditions, connectivity and power supply.

Use appropriate independent checks where necessary.

Aviya does not guarantee that every calculation, notification, reminder or connected-device reading will be delivered, complete or accurate.

11. Farming information and professional advice

Aviya's information, articles, recommendations, prompts, calculations and operational summaries are provided for general information and operational support.

They are not a substitute for veterinary, agricultural, financial, accounting, tax, legal or other professional advice appropriate to your circumstances.

You remain responsible for decisions concerning animal welfare, disease management, biosecurity, medication, feed, housing, farm operations, employment, regulatory compliance and commercial activities.

Seek appropriate qualified advice where necessary, particularly for animal-health concerns or urgent conditions.

Aviya does not guarantee flock performance, bird survival, growth rates, feed conversion, market prices, revenue, profitability or any other farming or business outcome.

12. Acceptable use

You must not:

  • use Aviya for unlawful, fraudulent or deceptive purposes;
  • access an account, Batch, system or information without authority;
  • interfere with, damage or disrupt Aviya or its infrastructure;
  • introduce malware or attempt to bypass security controls;
  • probe or test vulnerabilities without written authorisation;
  • impersonate another person or misrepresent your authority;
  • harass, threaten or abuse another person;
  • collect, process or disclose another person's information unlawfully;
  • send spam or misuse invitations or communication features;
  • copy, reverse engineer or commercially exploit Aviya's software except where applicable law expressly permits this;
  • reproduce or exploit Aviya's protected content beyond the permissions provided by these Terms;
  • use automated systems in a way that places unreasonable load on the service or bypasses restrictions; or
  • use Aviya in a manner that materially interferes with another person's legitimate use of the service.

13. Aviya software, branding and content

Aviya and its licensors retain all applicable rights in Aviya's software, interface, designs, artwork, branding, documentation and content, except for content belonging to users or identified third parties.

Subject to these Terms, Aviya grants you a limited, revocable, non-exclusive, non-transferable right to use the service for your personal farming activities or internal business purposes.

You may share links to publicly available Aviya website content.

You may not reproduce, distribute or commercially exploit Aviya's software, artwork, branding or substantial portions of its content without permission except where applicable law permits this.

Third-party names, logos and trademarks belong to their respective owners.

14. Third-party services and suppliers

Aviya may rely on or integrate with third-party services such as cloud hosting, authentication, communications, analytics, payment services, application stores and connected tools.

Those services may be subject to their own terms and privacy practices.

Where Aviya displays a supplier name, product, link or listing, this does not by itself constitute an endorsement or guarantee of that supplier's products, prices, quality, reliability or availability.

Unless Aviya expressly states otherwise, transactions between you and suppliers or other third parties are between you and that party.

15. Waitlists and marketing communications

Joining a Aviya waitlist allows us to provide the updates described when you sign up.

Joining a waitlist does not itself:

  • create a Aviya app account;
  • guarantee admission to a testing programme;
  • reserve a product or service; or
  • create an obligation to purchase anything.

You can unsubscribe from marketing communications using the unsubscribe method provided in the communication.

We may still send important account, security, legal or service communications where necessary.

16. Charges, purchases and subscriptions

Some Aviya features may be free and others may require payment.

Where a paid feature, subscription or other digital purchase is offered, applicable pricing and material purchase conditions will be displayed before you purchase it.

Creating an account or joining a waitlist does not by itself authorise Aviya to charge you.

Where a purchase is made through the Apple App Store, Google Play or another authorised application marketplace, the marketplace's purchase, billing, subscription, cancellation and refund terms may also apply.

Where a subscription automatically renews, the renewal period, applicable price and other material terms will be shown before purchase.

Unless otherwise stated, an automatically renewing subscription continues until cancelled in accordance with the applicable application-store or payment-provider rules.

Deleting your Aviya account does not necessarily cancel an active subscription managed by an application store. You should cancel any applicable subscription through the relevant store account where required.

Where supported by the relevant store, Aviya may provide functionality to restore eligible purchases.

Any future introduction of charges or material change to an existing paid arrangement will be communicated before it applies and will remain subject to applicable law and application-store requirements.

17. Privacy

The Aviya Privacy Policy, available at:

https://aviya.africa/privacy

explains how Aviya collects, uses, stores, shares and protects personal information.

The Privacy Policy also explains relevant retention and deletion practices and how you may exercise applicable privacy rights.

Acceptance of these Terms does not replace any consent that applicable law requires us to obtain separately.

For privacy questions or requests, contact:

legal@aviya.africa

18. Account and data deletion

You may request deletion of your Aviya account at any time.

Where account creation is available in the Aviya mobile application, Aviya provides an account-deletion path from within the app.

You may also initiate account deletion outside the app at:

Delete your account online

The deletion process will explain any confirmation or identity-verification steps that are reasonably necessary to protect your account against unauthorised deletion.

Deletion means deletion of your Aviya account and the personal information associated with it except for information that Aviya is legally permitted or required to retain.

Temporary suspension, deactivation or disabling of an account is not account deletion.

Where technically and legally applicable, user-generated content associated with a deleted account will also be deleted or anonymised.

Some records created as part of a shared Batch may constitute operational records belonging to or relied upon by other authorised Batch participants. Where there is a legitimate and lawful reason for those underlying records to remain, Aviya may preserve the record while deleting or anonymising the deleted user's personal account information and association to the extent appropriate.

Information may also be retained where reasonably necessary and legally permitted for purposes such as:

  • compliance with legal obligations;
  • preventing fraud or abuse;
  • resolving disputes;
  • exercising or defending legal claims; or
  • maintaining necessary financial or transactional records.

Where information is retained after account deletion, it will no longer be used for unrelated purposes.

If deletion cannot be completed immediately, we will provide appropriate information about the status of the request and confirm completion where appropriate.

Account deletion does not automatically cancel a subscription billed through Apple, Google or another third-party payment provider. Where applicable, you should separately cancel the subscription through that provider.

Uninstalling Aviya does not delete your account.

Questions concerning account deletion may be sent to:

support@aviya.africa

Further information about deletion and retention is available in the Aviya Privacy Policy.

19. Suspension and termination

We may restrict, suspend or terminate access where reasonably necessary to:

  • protect users or Aviya;
  • address a serious or repeated violation of these Terms;
  • investigate suspected abuse, fraud or unauthorised activity;
  • protect the integrity or security of the service; or
  • comply with law or a lawful request.

Where reasonably practicable, we will explain the reason and provide an opportunity to resolve the issue.

Immediate action may be necessary where there is an urgent security concern, serious abuse, unlawful activity or legal restriction.

You may stop using Aviya at any time.

If you also wish to delete your account, use the account-deletion process described in Section 18.

Termination does not affect rights or obligations that arose before termination.

20. Availability and changes to Aviya

We aim to provide a useful and reliable service, but Aviya may occasionally be unavailable because of maintenance, upgrades, connectivity issues, infrastructure failures, third-party services or other circumstances.

We may add, improve, modify or discontinue features as Aviya develops.

Where a change materially affects an existing service you use, we will provide reasonable notice where practicable.

Security, legal or urgent operational changes may need to take effect immediately.

Changes affecting paid services remain subject to applicable purchase terms, application-store requirements and consumer rights.

21. Warranties and responsibility for loss

To the extent permitted by applicable law, Aviya is provided on an “as available” basis.

We do not guarantee uninterrupted or error-free operation, compatibility with every device, uninterrupted synchronisation, complete accuracy of user-entered information or suitability for every farming operation.

To the extent permitted by applicable law, Aviya is not responsible for indirect or consequential loss arising from your use of the service, including loss of profits, opportunities or business resulting from reliance on inaccurate or incomplete user-entered information.

You are responsible for taking reasonable steps to protect important records, verify information used in significant decisions and reduce avoidable loss.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

This includes any liability or statutory obligation that applicable law makes mandatory.

Nothing in these Terms removes consumer or other legal rights that apply to you.

22. Application-store terms

If you download Aviya from the Apple App Store, Google Play or another application marketplace, your use of that marketplace and the copy of Aviya distributed through it may also be subject to the marketplace's applicable terms.

Where marketplace terms create rights that cannot lawfully be modified by these Terms, those rights remain unaffected.

Questions about Aviya itself should be directed to Aviya using the contact information in these Terms rather than to the application marketplace, except for matters that the marketplace itself handles, such as certain payment, subscription or refund issues.

23. Changes to these Terms

We may update these Terms to reflect changes to Aviya, applicable law, security requirements or the way our services operate.

The current version and effective date will be published at:

https://aviya.africa/terms

Where a change materially affects your rights or responsibilities, we will take reasonable steps to notify you before it takes effect where required or appropriate.

Where applicable law requires renewed agreement, we will obtain it.

If you do not agree to revised Terms, you may stop using Aviya and request deletion of your account.

24. Governing law and disputes

These Terms are governed by the laws of Zimbabwe, subject to any mandatory rights or protections that apply to you under the laws of another jurisdiction.

If you have a complaint or dispute, please contact us first so that we can attempt to resolve it.

Subject to any mandatory rights available to you under applicable law, disputes that cannot be resolved may be brought before the competent courts of Zimbabwe.

Nothing in these Terms prevents you from exercising a right to complain to a regulator, application marketplace or other dispute-resolution body where such a right applies.

25. General provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.

A delay or failure by Aviya to enforce a provision does not waive our right to enforce it later.

We may transfer our rights and obligations under these Terms as part of a legitimate sale, restructuring, merger or other business transfer, provided doing so does not unlawfully reduce your rights.

These Terms, together with any additional terms expressly applicable to a Aviya feature or purchase, constitute the agreement between you and Aviya concerning your use of the service.
